Representative Matters
- Chapter 11 Trustee for The Douglas Place, Inc., Bankruptcy No. 11-61065, during which time I oversaw continuing operations of the business from March 15, 2012 through the sale of the assets, approval of a liquidating plan of reorganization, and eventual closure of the case on January 24, 2014.
- Chapter 7 Trustee for McM, Inc., North Dakota Bankruptcy Case No. 17-30061. McM, Inc. was a farming operation that, at its peak, farmed in excess of 50,000 acres in Northeastern North Dakota. Originally, I was employed as the attorney for the North Dakota bankruptcy trustee, Cheryl Bergian. The bankruptcy estate obtained approval to operate McM, Inc. for the purpose of completing the harvest of crops and selling crops. In September of 2017, I was appointed the trustee. In total, the bankruptcy estate collected and distributed in excess of $9 million in crop proceeds in 2017 and has successfully pursued several avoidance actions.
- Assignment for the Benefit of Creditors of William Sczepanski, Court File No. 45-CV-17-39, and Sczepanski Farms, Inc., Court File No. 45-CV-17-40. Mr. Sczepanski and Sczepanski Farms, Inc. farmed almost 20,000 acres in Northwestern Minnesota. I was appointed assignee in the assignment for the benefit of creditors on January 30, 2017, with responsibility to liquidate and administer all non-exempt assets of the assignor, for the benefit of creditors, pursuant to the terms of Minn. Stat. §§576 and 577, and under the supervision of the Marshall County Court.
- Assignment for the Benefit of Creditors of the Ashby Farmer’s Co-Operative Elevator Company, Court File No. 26-CV-18-277. After it was discovered that Jerry Hennessey had embezzled in excess of $5.4 million to pay for personal expenditures, including hunting safaris, taxidermy and the purchase and improvement of real estate, I was appointed assignee in the assignment for the benefit of creditors on December 31, 2018, with responsibility to investigate the losses and liquidate assets, including the commencement of avoidance actions and other liability actions against Hennessey’s, officers and directors of the Co-Op and recipients of the embezzled funds.
- Assignment for the Benefit of Creditors of the estate of Mark A.Ward and MAWRLT Inc., Court File no. 39-CV-17-128. Following the death of the owner of a fishing resort on Lake of the Woods, I was appointed through the Ninth District Court in Lake of the Woods County with responsibility to oversee operations and sell the resort. I oversaw operations from June 22, 2017 through the sale of the resort and closure of the case on December 13, 2018.
- Replacement Trustee In re the Matter of the Revocable Living Trust of Marlys J. Anderson, Court File No. 56-CV-18-1096, appointed through the Otter Tail County Court with responsibility to sell a large commercial building as the resolution to litigation between the beneficiaries of the trust.
- Special Master in Tracy Becker v. Tod Becker and Becker Farms of Park Rapids, Inc., Court File No. 29-CV-18-78, appointed through the Ninth District Court in Hubbard County with responsibility to provide a report and recommendation regarding the equitable separation of their business interests in Becker Farms of Park Rapids, Inc.
- Debtor’s counsel in several Chapter 11 bankruptcies, including In re Daniel George Feneis, Bankr. No. 09-60317, In re The Dairy Dozen-Milnor, LLP, Bankr. No. 10-30377 (ND), In re The Family Link of Moorhead, LLC, Bankr. No. 14-60111, In re Caring Hands Home Care, Inc., Bankr. No. 17-60044, In re Richard Elbert, Bankr. No. 17-43768, Richland Farms Partnership, Richland Farms, Inc., Sixta Farms, LLC, Richland Eggs, Inc. and Richland Agronomy, Inc., jointly administered under Bankr. No. 19-30153.
